RecommendationVerified

For a foreign worker subject to authorization, prepare the work and residence file before employment. In the general category, also justify the impossibility of recruiting from the available labor market.

The framework of the Walloon Decree of June 6, 2024 applies since September 1, 2024. The SPW page provides for the single permit for employment of more than 90 days and its electronic submission by the employer or its agent on Working in Belgium. First verify any possible exemptions and particular categories.

Prepare notably passport, signed contract, diploma, proof of access to a regulated profession if necessary, and residence documents. The contract must specify the position and its classification, location, duration, schedule, remuneration and joint committee, in accordance with article 15.

Article 2 notably allows relying on the specific list of occupations in shortage or a certificate from Le Forem after an ad published for at least five weeks, also distributed via EURES. The page also provides for active management and pre-selection by Le Forem. Obtain proof before submitting the application.
