Night work: rules since June 2026

RecommendationVerified

Use the current rules of the law of March 16, 1971, not old e-commerce summaries. Since June 1, 2026, night work is permitted in principle.

Night remains defined as 8 p.m. to 6 a.m. The employer must observe rest periods, collective agreements, prevention and the procedure for introducing into work rules. Distinguish schedules outside midnight-5 a.m., under article 36, from regimes with night work under article 38.

In distribution and legally defined related sectors, including certain logistics activities, night bonus rights for new entrants since June 1, 2026 are limited to work between 11 p.m. and 6 a.m., except for collective or regulatory derogation coming into force after that date. Workers already employed retain their applicable rights between 8 p.m. and 6 a.m.

Before publishing schedules and bonuses, check the scope, the worker's situation and collective agreements. Night authorization does not exempt from the procedure for introducing the regime.
