Equal treatment in Flemish competencies

The decree of July 10, 2008 prohibits discrimination in matters falling under Flemish competencies, notably training and placement. The decree of May 8, 2002 must also be examined when it provides greater protection to the person.

Articles 15 and 15bis cover direct and indirect discrimination, harassment, instructions to discriminate, and refusal of reasonable accommodations. Protected criteria include notably age, sex, origin, disability, language, and family responsibilities.

Article 20, in its version applicable since June 7, 2026, targets in particular selection criteria, access to employment, vocational training, and placement, within the limits of the competencies of the Flemish Community and Region. Do not present this decree as replacing all federal labour legislation.

For situations subject to the decree, Article 26bis requires facilitating requests for reasonable accommodations and informing the applicant of follow-up within 30 days. An exceptional extension of 30 days must be justified and announced within the initial period.
