Language of personnel documents in Brussels

Legal obligationVerified

In Brussels, Article 52 of the coordinated laws of July 18, 1966 governs the language of personnel documents of industrial, commercial, or financial companies. The worker's language must be considered.

Article 52, § 1, targets acts and documents required by law or regulations as well as those for personnel. In the Brussels-Capital Region, documents for French-speaking staff are drafted in French and those for Dutch-speaking staff in Dutch. The operating headquarters is determinative.

§ 2 authorizes additional translations when staff composition justifies, without replacing the required version. Article 59 provides for replacement of irregular documents.

When preparing hiring, verify the language of individual documents and contract. Article 52 does not, by itself, create a general obligation to publish every private posting in both languages. Public services follow other provisions of these laws.
