Single permit: new European framework

Directive 2024/1233 revises the single permit procedure and strengthens the rights of workers from non-EU countries. Its transposition deadline was 21 May 2026.

Article 5 requires a decision within 90 days of a complete application, including the labour market assessment. Article 8 allows an exceptional extension of 30 days, duly justified by the complexity of the case. A request for additional documents may pause the deadline. If the employer submits the application, it must inform the applicant of its progress and outcome.

Article 11 provides for changes of employer subject to national conditions and protects certain periods of unemployment. Articles 18 to 20 set the transposition deadline at 21 May 2026 and repeal Directive 2011/98 on 22 May 2026. These European deadlines do not authorise anyone to start work. Check the Belgian procedure that actually applies and the residence and work authorisations before employment begins.
