Gender equality in selection and pay
Directive 2006/54 prohibits sex discrimination in recruitment and requires equal pay for equal work or work of equal value. Pregnancy cannot justify unfavourable treatment.
Article 14 covers access to employment and selection criteria at all levels. Article 2 includes sexual harassment and less favourable treatment related to pregnancy or maternity leave. Remove sex-based criteria without legal justification and assess the skills needed for the role.
Article 4 covers all elements of pay and the job classifications used to set them. Compare roles using the same criteria for women and men. The exception in Article 14, paragraph 2, requires a characteristic that constitutes a genuine and determining occupational requirement, with a legitimate aim and a proportionate requirement.
