Age, disability and beliefs: equality in recruitment

RecommendationVerified

Directive 2000/78 protects applicants against discrimination based on beliefs, age, disability or sexual orientation. Provide the reasonable accommodation needed for selection.

The Commission notes that the prohibitions cover selection criteria, recruitment, training and employment conditions. They also cover indirect discrimination, harassment and instructions to discriminate. Use criteria related to the job’s tasks and keep a record of the professional reasons for decisions.

Article 5 requires reasonable accommodation to give people with disabilities access to employment, unless this imposes a disproportionate burden. Assess specific adjustments to interviews, tests or the role. Consider available support before concluding that the burden is excessive. Protection covers public and private employment. The directive was published on 2 décembre 2000.
