Written contract, trial period, and student notice

Legal obligationVerified

Sign the contract before starting work. Title VII of the law of July 3, 1978 provides for a trial period and specific notice requirements.

Articles 123 and 124 require an individual written agreement no later than the start of work, with start and end dates. Article 126 allows a student to leave without notice or compensation if a proper written agreement is missing or if mandatory declaration is not made; certain omissions subject the employer to permanent employment contract rules.

Article 127: the first three working days constitute the trial period, with termination possible without notice or compensation. Successive student contracts for the same position do not allow repetition of the trial period.

Article 130: for an engagement not exceeding one month, notice is three days for the employer and one day for the student; beyond that, seven and three days. It begins the Monday following notification. Article 129: after more than seven days of incapacity, the employer may terminate by providing compensation corresponding to the remaining notice period.
